Terms of use

These terms are issued by Samman Publishing House, Kathmandu, Nepal (SPH, we, us). They are effective from 16 August 2026. Review sits with SPH operations. They govern use of this website and platform. A signed publishing, rights, supply or employment agreement, where one exists, prevails for that relationship.

By using the site you agree to these terms and to the Privacy policy. If you do not agree, do not use the site.

1. Who may use this site

You must be 18 or over. If you use the site for an organisation, you confirm you have authority to bind it. You are responsible for the accuracy of what you submit and for keeping account credentials to yourself.

2. The website is a publishing house site

SPH develops authors, produces books and builds campaigns around those books. This website is how that work is shown and how some of it is requested. It is not a marketplace for third-party sellers, not a social network, and not a guarantee that any particular book will be published, stocked or delivered on a stated date unless a confirmed order or signed agreement says so.

3. Accounts

Some parts of the platform require an account. We may refuse, suspend or close an account where we reasonably believe these terms, the law, or another person's rights are at risk. Closing an account does not delete records we must keep.

4. Publishing applications

• Sending a Start a Book application is a request that we read your materials. It is not a contract to publish, not a reservation of a slot, and not an offer we are obliged to accept.
• We read every application and reply either way. We may decline without giving a reason that would disclose another author's work or our internal assessment.
• Nothing on this site is an invitation to treat that we cannot withdraw. A quote is not binding until we issue it and you accept it in the way the quote says.
• You confirm that you have the right to share what you share, including the manuscript link, and that sharing it with SPH does not infringe anyone else's rights.

5. Publishing services

SPH provides author-funded publishing services. Authors pay for scoped work. SPH is not, on this platform, a traditional royalty publisher that buys manuscripts. Quotes, payment verification, production approvals and publishing decisions require human review. AI-assisted tools, where used inside operations, do not decide price, publication or payment.

Work begins only on the scope in an accepted quote or signed agreement. Changes of scope may need a new quote. Dates we give are estimates unless the agreement says they are not. Printing is coordinated with external press partners; SPH does not warrant another company's plant, paper or schedule.

6. Copyright in books

Authors publishing with SPH retain copyright in their work unless a specific signed agreement says otherwise. SPH may display title, cover, credits and approved public copy on this site because that is how a publishing house shows its list. Public display of a published book is not a transfer of copyright.

7. Your content

You keep whatever rights you have in material you submit. You grant SPH a worldwide, non-exclusive licence to use that material solely to operate the platform and to perform the services you have asked for — including storing workflow records, showing you your own project, and, once a book is approved for the public catalogue, showing the public facts of that book. You warrant that your material is lawful and that you have the rights you claim.

8. Book orders

• A catalogue listing is an invitation to order, not a binding offer. Price, format and availability are as shown on the book page at the time you order, and may change.
• An order is accepted only when SPH confirms it after payment review. Uploading payment proof is not payment. Payment is not final until authorised staff verify it.
• We may cancel an order we cannot fulfil, including where stock, rights or a suspected problem with payment or identity requires it. If we have taken money for an order we then cancel, we will refund the verified amount we actually received for that order, by a method we can execute.
• Delivery, pickup and any return are as confirmed on the order. Risk in a physical book passes on delivery or pickup as Nepalese law provides. We are not liable for a carrier delay we did not cause.

9. Prohibited use

• Do not attempt unauthorised access, disrupt the service, or probe it except through a disclosure we have invited.
• Do not scrape, harvest or republish the site in a way that competes with it or burdens it, beyond ordinary indexing that respects robots.txt.
• Do not submit unlawful, defamatory, infringing or deceptive material, or material that impersonates SPH or another person.
• Do not use the site to send spam or to upload malware.
• Do not present SPH as having published, endorsed, stocked or sold something we have not.

10. Our intellectual property

The site's design, software, house copy, trademarks and the SPH name are ours or our licensors'. You may not copy the site, frame it, or use our marks except as needed to use the service or as Nepal's copyright exceptions allow. Book text and covers remain the author's or the rightsholder's, as the catalogue and any agreement say.

11. Third parties

The site may link to Google Drive, YouTube, retailers or other sites we do not control. Their terms apply there. We are not responsible for their content, availability or privacy practices. Manuscripts live on Drive because you put them there.

12. No warranty

The site and platform are provided as available. We do not warrant uninterrupted access, error-free software, or that a particular book, campaign figure or page will remain unchanged. Catalogue facts are as recorded in our systems. We do not invent ISBNs, reviews, awards, sales figures or stock. Where a fact is missing, it is omitted.

13. Limitation of liability

To the maximum extent permitted by the law of Nepal, SPH, its officers, staff and contractors are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profit, data, reputation or business, whether in contract, tort or otherwise, even if advised of the possibility.

To the same extent, SPH's total liability arising out of or relating to the site or platform is limited to the fees you actually paid to SPH for the specific service giving rise to the claim in the twelve months before the claim, and if you paid nothing, to five thousand Nepalese rupees. Nothing in these terms excludes liability that Nepal law does not allow to be excluded, including liability for fraud or for death or personal injury caused by negligence where that cannot be excluded, or rights you have under the Consumer Protection Act, 2075 (2018) that cannot be waived.

14. Indemnity

You will indemnify and hold SPH harmless against claims, losses, damages, costs and reasonable legal fees arising from your content, your breach of these terms, your infringement of another person's rights, or your misuse of the site, except to the extent caused by SPH's own fraud or wilful misconduct.

15. Suspension and termination

We may suspend or end access immediately if we reasonably believe these terms, a signed agreement, or the law requires it. You may stop using the site at any time. Sections that by their nature should survive — including copyright, limitation of liability, indemnity, governing law and records we must keep — survive.

16. Force majeure

We are not liable for delay or failure caused by events beyond reasonable control, including failure of a printer, carrier, payment rail, cloud provider, power, communications, or government action.

17. Changes

We may update these terms. The date at the top of this page is the effective date of this version. Continued use after a change is acceptance. If you have a signed agreement, that agreement's change clause governs that work.

18. Governing law

These terms are governed by the laws of Nepal. The courts of Kathmandu have exclusive jurisdiction, except that SPH may seek injunctive or equivalent relief in any forum to protect its intellectual property or confidential information.

19. General

If a provision is held unenforceable, the rest remains. These terms are the entire agreement for use of the site, except where a signed agreement says otherwise. You may not assign your rights without our written consent. We may assign to a successor of the publishing house. No waiver is continuing unless we say so in writing. Nothing here creates a partnership, agency or employment relationship.
